Homeowner donations will keep the lawsuit moving forward.
With over 600 class members, a modest amount from each person goes a long way, especially on a monthly basis. Many neighbors are contributing the $93 monthly fee to the fund instead of paying it to 18 Paradise. Others are paying more or less depending on their circumstances.
A trust fund has been created under the direction and control of an independent attorney to accept homeowner contributions and pay the expenses of the lawsuit. That independent control will ensure that all funds are accounted for and properly spent. A Homeowner Budget and Audit committee further oversees the work of the trustee.
Any funds remaining when the lawsuit is over will be refunded pro rata.
A pro rata distribution of surplus means that each contributor will receive a surplus payment in direct proportion to his/her total contributions within the whole trust fund.
Example: If the total fund is $100 and a contributor has put in a total of $10, then a pro rata distribution means 10% of the surplus.
