Statement Regarding Recent Letter from IMM Capital
Many parcel owners in the Homestead PRD have received letters from IMM Capital asking them to pay maintenance fees which they claim are due under the Master Declaration.
IMM Capital also announced, in that letter, that it plans to hold a homeowners meeting.
We recommend that parcel owners and class members reply to the letter encouraging IMM to hold the meeting sooner rather than later, and hold off paying anything to IMM Capital until after the planned homeowners meeting where IMM Capital will have an opportunity to explain the following threshold issues.
Is IMM Capital the current owner of the common open space? While they appear to have had dealings with the current owner 18 Paradise, it does not appear that title has been conveyed from 18 Paradise to IMM Capital.
In light of the foregoing, is IMM Capital legally a successor declarant under the Master Declaration?
That said, all parcel owners and class members are encouraged to attend any homeowners meeting organized by IMM Capital to facilitate communication regarding not only the current status of Homestead, but also productive ways to address the current and future concerns of the parcel owners.
