UPDATE: November 13, 2020 – Judge Olson reversed his original decision and granted our motion for class action certification.
In response to our motion, MJ Management obtained declarations from 29 people stating that they did not want a judge to decide if they should have a homeowners association. Although we told the judge that over 230 people have expressed their support on the website, he was not convinced.
On October 9, 2020, Judge Olson denied our motion for class action certification because he was concerned that not enough homeowners had expressed their support for the lawsuit.
Judge Olson has not signed his order yet, and we have the chance to ask him to reconsider his decision. We think that a large number of declarations from Homestead owners expressing their support for the class action will change his mind.
