Homestead owners are being sent misleading invoices for maintenance fees.
Under the Declaration of Covenants, the maintenance fee is owed to the Declarant, which is 18 Paradise. If
you receive an invoice for maintenance fees from anyone other than 18 Paradise, we recommend that you do
not pay it.
Class counsel David Andersson and Matt Davis are in the process of filing motions with the Court for an
accurate accounting of the amounts that parties subject to the disputed maintenance fees may owe each
other. 18 Paradise and its agents owe a significant refund of fees collected under the illegal and void 6th and
7th amendments.
Businesses can and often do assign debts to other companies. For example, it is common for mortgages to be
assigned to a servicer. Anyone other than the original creditor who demands payment must be prepared to
present proof that the debt was assigned to it. As a matter of law, such proof can come only from the original
owner of the debt.
The invoice that we saw was sent by the Possinger Law Firm on behalf of MJ Management. That invoice stated
that it was sent “regarding the outstanding balance on your account for amounts owed to MJ Management
LLC. for the time period between January 2020 through May 2023 for payment of Homestead PRD
Maintenance Fees.” However, we are not aware of any agreement by any Homestead owner to pay
maintenance fees to MJ Management. The fact that the invoice never explains why the amount would be
owed to MJ Management instead of 18 Paradise is false and misleading and may constitute consumer fraud.
